Government considers disabling cellphones in cars

Cell phones are only a small part of the problem. Garmin, Ipods that plug into the radio, Onstar. Not to come off as a Luddite, but for the most part technology is the big culprit along with peoples desire to be connected at all times.

The laws are on the books, enforce what is there. The police choose what laws they want to enforce and when, always has been like that always will. For the most part, if you get popped for anything it was just your unlucky day.
 
To be honest, I'd prefer to see increased driver's education before anyone can get a license. Throw some defensive driving into the program and things should get better.
 
I see cops on their phones while driving very frequently. The current law is never enforced...

39:4-97.3 Use of wireless telephone, electronic communication device in moving vehicle; definitions; enforcement.

1. a. The use of a wireless telephone or electronic communication device by an operator of a moving motor vehicle on a public road or highway shall be unlawful except when the telephone is a hands-free wireless telephone or the electronic communication device is used hands-free, provided that its placement does not interfere with the operation of federally required safety equipment and the operator exercises a high degree of caution in the operation of the motor vehicle. For the purposes of this section, an "electronic communication device" shall not include an amateur radio.

Nothing in P.L.2003, c.310 (C.39:4-97.3 et seq.) shall apply to the use of a citizen's band radio or two-way radio by an operator of a moving commercial motor vehicle or authorized emergency vehicle on a public road or highway.

b.The operator of a motor vehicle may use a hand-held wireless telephone while driving with one hand on the steering wheel only if:

(1)The operator has reason to fear for his life or safety, or believes that a criminal act may be perpetrated against himself or another person; or

(2)The operator is using the telephone to report to appropriate authorities a fire, a traffic accident, a serious road hazard or medical or hazardous materials emergency, or to report the operator of another motor vehicle who is driving in a reckless, careless or otherwise unsafe manner or who appears to be driving under the influence of alcohol or drugs. A hand-held wireless telephone user's telephone records or the testimony or written statements from appropriate authorities receiving such calls shall be deemed sufficient evidence of the existence of all lawful calls made under this paragraph.

As used in this act:

"Citizen's band radio" means a mobile communication device designed to allow for the transmission and receipt of radio communications on frequencies allocated for citizen's band radio service use.

"Hands-free wireless telephone" means a mobile telephone that has an internal feature or function, or that is equipped with an attachment or addition, whether or not permanently part of such mobile telephone, by which a user engages in a conversation without the use of either hand; provided, however, this definition shall not preclude the use of either hand to activate, deactivate, or initiate a function of the telephone.

"Two-way radio" means two-way communications equipment that uses VHF frequencies approved by the Federal Communications Commission.

"Use" of a wireless telephone or electronic communication device shall include, but not be limited to, talking or listening to another person on the telephone, text messaging, or sending an electronic message via the wireless telephone or electronic communication device.

c.(Deleted by amendment, P.L.2007, c.198).

d.A person who violates this section shall be fined $100.

e.No motor vehicle points or automobile insurance eligibility points pursuant to section 26 of P.L.1990, c.8 (C.17:33B-14) shall be assessed for this offense.

f.The Chief Administrator of the New Jersey Motor Vehicle Commission shall develop and undertake a program to notify and inform the public as to the provisions of this act.

g.Whenever this section is used as an alternative offense in a plea agreement to any other offense in Title 39 of the Revised Statutes that would result in the assessment of motor vehicle points, the penalty shall be the same as the penalty for a violation of section 1 of P.L.2000, c.75 (C.39:4-97.2), including the surcharge imposed pursuant to subsection f. of that section, and a conviction under this section shall be considered a conviction under section 1 of P.L.2000, c.75 (C.39:4-97.2) for the purpose of determining subsequent enhanced penalties under that section.

Just another do as I say, not as I do. In reality how many cops are talking about official duty? Most are talking to friends of family. At the very least, they should pull over, unless in fact, they are on official business.

What kind of message do it send when a cop is on the phone while driving, regardless if it is legal for him to do so?

More laws aren't the answer, common sense is.
 
handsfree, speakerphone, whatever. I don't think it helps. Holding the phone to your ear isnt distracting. The talking is what distracts.
That was my exact point in saying a call grabs your attention even with a handfree device

I can easily and prefer driving with one hand but the truth is there are others that should not... An example of that is a 16 year old from P.A. who is doing 85 on the highway ... I never assume others are capable of doing what others can...

More laws aren't the answer, common sense is.

Make it a law that police officer are not exempt and they will be in direct violation of the law they are paid to enforce...

Most cops are in the back of a mall sleeping in their cars while still being able to retire on full benies after 10 years of service. Who are they kidding?!

I think the govt needs to start focusing on improving the economy and putting people back to work so they can actually afford to buy a cell phone. I dont need them telling me what I can or cant do in my car, what type of car to drive and how long I'm allowed to keep my lights on. Please. Spare me.

Way off base, man. Like Spence said, there are a few bad apples but I'm sure when called they will do their job. I think they have to work 20 years for full.
 
police officers have special dispensation to use their cell phones for, one reason being as not to tie up the radio and block important dispatches. The problem is that they abuse it talking to their hooker girlfriends while their wife and 2 kids are at home.

30 day suspension for first offense, at least the drunk driver is trying to pay attention

I think it like most of our laws and regulations, by making them more complicated or by giving exception people find ways to abuse them. that being said I argree with panhead I know a few cops and they are good people, as well as I dont agree with the exception. There is no legit business reason for a cop to be on a phone while driving during duty and not use a hands free device. and no johnny I am have not been a cop all this time.

I'm sorry your wife cheated on you with a cop... They are cell phone abusing scumbags afterall. I would bet a limb that everyone posting in this thread has used a cell phone while driving. But it's never about us is it? It's always that other asshole; or in this case, the fault of law enforcement. 🙄

Would you look at that..I did not know they were exempt. But, I still believe they should be held under the same laws as private citizens.

If it is OK to bash cops for sleeping behind a mall (very hard to justify, but there might be a very good reason), I guess everyone that is posting or surfing the web is screwing the boss out of time and money. How many people can say with 100% honesty that they have their nose to the grind stone all work day?

If you aren't working, why are you on the interwebs instead of out looking for gainful employment?

nope, not to some high school bully with a badge or the kings men collecting their "toll" to cross the stream.

they write tickets base on their mood not your guilt and they lie at a rate close to the worst politicians.

Here is a conversation I had with one but it was a good representation of most encounters.

I am driving down a main street heading about 3mi. home after the movies and dropping off a friend, its almost 10 pm on a Wednesday. I saw 2 P.O. in the marked car but was not worried with them bc I was doing nothing wrong.
From 250 yards away until the light that they were at I was cruising at 23mph in a 25 and stopping at a red light(which had been red this entire time). I was driving a minivan without tints and was completely stock. When the light turns green they throw on their lights and pull me over( i have no idea for what).
They tell me I was talking on a cell phone but I dont like cell phones and wasnt carrying one(they think they can pull anyone over for nothing and since everyone has a cell this is a could excuse). I was polite but adamant that I was not on a cell and didnt have one in the vehicle and told them to search it. After 10 minutes they come back to me and its "Oh um well uh you didnt have your seatbelt on".This was another lie but how to argue with 2 officers that are corrupt. Well after taking a day off of work to fight it, I still had to pay the ticket and now with additional court fees.

I had 1 or 2 encounters where an on-duty P.O. didnt abuse their authority and only one that was polite and treated me with respect which was when I got pulled over on my b-day for having the 3rd brakelight out which I was unaware.


So I do not care how they feel about my statements against their general facist attitude. Hooray for me and fuck you attitude is nearly a prerequisite for local L.E.
