I have seen people typically keep the car and have it repaired by a small repair shop that will do it for less than what the insurance company quotes. I would love to keep this car, best one Ive had. I dont think keeping it and repairing it myself is an option, Im on the unemployment program and tight money looks at me and says "Damn!...now that some tight money! "
Plus, I dont know how messed up it is...this was my car last January with a little over 7k in damage and that was mostly the hood that took the brunt square on the nose...

HA! I just picked up the police report and it says that the woman I hit said I was traveling at a high rate of speed.... uh.... so you figured that would be a good time to pull out in front of me and my kids? and the fact that she wasnt even looking in my direction until I was plowing into the side of her car.... she also has a witness stating that I was traveling at a high rate of speed.. although her vehicle was blocked by a parking lot berm, and probably saw my car as the accident was happening.
(sniff...sniff) you smell that?...... smells like some kinda BS lawsuit brewing.
I dont have any contributing factors according to the report... she has a careless driving summons for failing to properly yield to traffic or pedestrian.

My car is totally paid off, now I dont have a car, or money to buy one, or a job to make payments on one... oh, and a pinched nerve in either my neck or elbow that is causing a portion of my hand and two of my fingers to be numb with pins and needles, and my ears are still ringing so bad i want to cut my head off.....
ugh.

Sounds like a call to a Lawyer is unfortunately at hand.

You definitely have a vg case any lawyer will take.
The PD call her @fault w/ the careless driving, which is a moving violation.
Add in numb fingers/part of hand and most lawyers will gladly sue taking payment from settlement/civil results. However expect them to want 1/4 to 5/8 of award. Don't let them take more than 1/3.
 
This all sucks!.... I'm not a person who is sue happy, and I feel like I'm being forced into doing something I'm not entirely comfortable doing. I never sued anyone before, and I take full responsibility for anything that I do that results in consequences... I learned a long time ago that not being responsible for your own actions will come back on you with a vengeance, but all this is making me feel like a scumbag.
I definitely have injuries from this accident that I did not have before this womans neglegence. I had a decent car that I could use to drive my kids to
their activities, and pick them up from school, and get to job interviews, and transport my bike to all the awesome places I love to ride... before this womans neglegence..
I am grateful that my kids and I aren't dead or seriously injured.
I have an appointment on Monday and we will see what happens... Money can't fix everything, it helps, but it doesn't make me one bit happy thinking that my ears are ringing to the point that I want to cry, and my hand being numb.... 🙁
I guess I will just have to wait and see.
Just don't feel right about any of this crap, and wish it never happened .

Sean, you really have no choice but to sue her. Insurance will put you at least 25% at fault just for being on the road.
I had a drunk woman run a stop sign plowing right into my passenger side sending me into the guard rail. Totaled out my car which was paid off, insurance gave me $800 for it and said if I wanted more I had to sue her. Hindsight being what it is, I should have gone after her, but I took what they offered and went in debt for the next 5 years.

After all is said and done, I vote for Matt's idea. The running joke on my job was the car is worth more from the roof line up then down.

Ok, then don't sue. Most ins co and cc's prefer to use binding mediation. Its a much, quicker process and isn't a lawsuit.
However it typically still uses lawyers. While one isn't required it is recommended. Go watch the demi moore for dramatized view of arbitration.

Fyi, if a lawyer takes the case based on the ending then you don't have to write any check.
