The point is not about how many lawyers MT Creek has (and I'm sure the state of NJ has plenty). There is no public outcry when someone gets injured doing a risky sport not using the most BASIC SAFETY equipment. It's even the law for minors to wear helmets.

The park can get hit with frivolous lawsuits if someone gets bit by a chipmunk, trips over their own 2 feet in the parking lot or numerous other things that have nothing to do with MTB.
