Bicycle Commuter Tax Provision

I apologize, but trying to read legal-eze is like trying to read Japanese for me.

Apparently as of January 1st, the bicycle commuter tax provision is enacted, enabling those who commute to work to receive $20 per each month commuted.

I can't seem to figure out from the legal document,

a) Who should be paying the cyclist? It says the employer, but what is my boss's incentive to give me $20 a month? Is there paperwork he or I need to fill out?

b) What is considered a 'month of commuting'? From early spring to late fall i TRY to bike to work 5 days a week, but you get horrible weather or oversleeping here and there and need to drive in? What is the minimum days-per-month to qualify as a commuter?


It seems like something I would definitely qualify for, and an extra $20 in my pocket never hurt, but maybe some of you are better read on this provision than I am. Thanks!

A lot hinges on (A), by the way, because my boss is a cheapskate and he is among the rest of the crew at work that heckles me for biking to work...
